Product: Lean Maturity Assessment App (“App”).
By creating an account, starting a trial, or using the App, you agree to these Terms.
1. Introduction
The App is a cloud-based platform that helps organizations assess, benchmark, and improve Lean/Operational Excellence maturity. It implements a research-backed model developed by Prof. Sanjay Bhasin and refined/digitized by DLM.
2. Service Description
The App provides:
- A structured assessment across eight dimensions: Leadership, Strategy, Business Benefits, People, Culture, Performance, Process, and Customer Focus.
- Interactive dashboards, sector/geography benchmarks, perception-gap analytics, and AI-assisted improvement roadmaps.
- Plan options (e.g., Standard, ILSSI, Premium) and optional integrations (e.g., Microsoft AppSource, Stripe).
We may add, change, or remove non-core features from time to time.
3. Accounts, Access & Plans
- You must provide accurate registration details and keep credentials confidential.
- Plans may include free trials; at the end of a trial, access may downgrade or require payment.
- “Premium” may be purchased via Microsoft AppSource (then “Configure SaaS account”) or directly via Stripe; both unlock the same Premium capabilities.
- If your organization assigns you an account, your administrator controls access.
4. User Responsibilities
You agree to:
- Accurate input: Provide complete, honest responses; avoid aspirational scoring.
- Representative sampling: Seek a statistically reliable and stratified sample (e.g., seniority, function, gender, tenure) for valid results.
- Reassess periodically to maintain current data.
- Confidential use: Share results only with authorized stakeholders.
- Compliance: Follow applicable laws and organizational policies (privacy, confidentiality, employment, procurement, export).
5. AI Functionality
The App includes AI assistance to clarify terms and suggest evidence-based actions. AI does not choose answers or set scores. Outputs are guidance only and should be validated by your organization.
6. Data Handling & Privacy
- We process assessment data per our Privacy Policy and applicable data-protection laws.
- Unless legally required or explicitly authorized by you, we do not disclose identifiable assessment results to third parties.
- We may use anonymized/aggregated data for benchmarking, research, and product improvement (e.g., ILSSI studies).
- Data is hosted with reputable cloud providers; security controls are designed to protect confidentiality, integrity, and availability.
- A Data Processing Addendum (DPA) can be provided on request for Premium/enterprise customers.
7. Third-Party Services & Billing
- Payments and subscriptions may be managed by Microsoft AppSource and/or Stripe; their terms apply in addition to ours.
- Taxes may be added where required.
- Unless stated otherwise, subscriptions renew automatically until canceled by the administrator per the channel’s process (AppSource portal or in-app/Stripe).
- Refunds are handled per the respective channel’s policy and applicable law.
8. Intellectual Property
The App, its code, UI/visualization logic, analytics, and the underlying maturity model are the intellectual property of Digital Lean Management and Prof. Sanjay Bhasin. All rights reserved. You may not copy, reverse engineer, resell, or create derivative works except as permitted in writing. Your organization retains rights to its own input data.
9. Methodology & Use Disclaimer
The maturity model is a diagnostic tool intended to support self-assessment and improvement planning. Results are indicative, not definitive certifications, audits, or legal/financial advice. We recommend using results alongside professional validation and change-management practices.
10. Acceptable Use
You must not:
(a) misuse, overload, probe, or disrupt the App or its security;
(b) share accounts;
(c) upload unlawful, harmful, or infringing content;
(d) attempt to bypass plan limits, user caps, or licensing.
11. Availability & Support
The App is provided on a commercially reasonable basis. We may perform maintenance from time to time. For support, use in-app help or contact hello@digitalleanmanagement.com. Beta features are provided “as-is” and may change or be withdrawn.
12. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided “as is” without warranties of any kind.
- DLM is not liable for indirect, incidental, special, consequential, or punitive damages, or for business decisions made from assessment outputs.
- Our aggregate liability for all claims in the preceding 12 months is limited to the fees paid for the App by your organization in that period (or £0 for free plans), excluding amounts paid via third-party marketplaces to the extent we cannot control.
Some jurisdictions do not allow certain exclusions/limits; in those cases, liability is limited to the maximum permitted by law.
13. Suspension & Termination
We may suspend or terminate access if we reasonably believe there is:
- a breach of these Terms;
- misuse or tampering with assessments/data/methodology;
- fraudulent, unlawful, or harmful activity.
Upon termination, access ends; we may retain or delete data per our Privacy Policy and legal obligations.
14. Changes to Terms
We may modify these Terms to reflect product updates, legal changes, or best practices. Changes take effect when posted. Continued use constitutes acceptance. Material changes will be highlighted via in-app notice or email when feasible.
15. Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where local law requires otherwise for consumers.
